By using this website and placing an order, you agree to these terms. Please read them carefully.

Orders and pricing

All orders are subject to acceptance and product availability. Prices and product descriptions may change without notice; we are not liable for typographical errors.

Meat is a perishable, often made-to-order product. Some of our items are priced by weight, so the exact price is not known until we weigh and pack your order. What you see in your cart for those items is an estimate, and the final charge is based on the weight we actually pack. How we handle payment for those orders is described under Payment below.

Payment

Retail orders are processed securely through Stripe. Wholesale accounts we have approved for terms are not charged when the order is submitted; those orders are invoiced and are payable on the terms recorded on your account.

Orders of fixed-price items only. By submitting the order you authorize a charge for your order total, including applicable tax and shipping.

Orders containing weight-priced items. We do not charge your card at checkout. Because we cannot know the exact price until we weigh and pack your order, submitting the order authorizes a temporary hold on your card for more than the estimated total shown in your cart. The hold is normally up to 20% above that estimate, and for a small number of items it can be higher, never above 35%. The amount being held is shown on the secure payment page before you confirm.

When your order is packed we charge you for the weight we actually packed. That final charge can be higher or lower than the estimate, but it can never be more than the amount we placed on hold. Anything we held and did not charge is released back to your card. A hold is not a charge: it does not move money, and if your order is canceled before we pack it, it drops off on its own, typically within about a week.

Shipping and risk of loss

Shipping terms are described in our Shipping Policy.

We ship your order in insulated packaging designed to keep it cold in transit. For consumer orders, risk of loss passes to you when your order is delivered to the address you gave us, or when you collect it for a pickup order. If your order arrives damaged, thawed or spoiled, contact us within 7 days of delivery and we will make it right under our Returns & Refunds policy; you do not need to deal with the carrier yourself. We are not responsible for losses caused by an address you gave us that was wrong or incomplete, or by a delivered order that was left unclaimed or was not refrigerated promptly.

For wholesale and other business orders, title and risk of loss pass to you upon delivery to the carrier.

Returns

Perishable food returns are governed by our Returns & Refunds policy.

Limitation of liability

To the fullest extent permitted by law, Shipley Farms is not liable for indirect or consequential damages arising from use of the site or our products. These terms are governed by the laws of the State of North Carolina.

Stored payment methods

If you choose a recurring (subscription) order or save a payment method at checkout, your card or bank account details are collected and stored by our payment processor, Stripe, Inc., a PCI-DSS Level 1 certified provider. Shipley Farms never receives or stores your full card or bank account number; we retain only a secure reference token issued by Stripe, along with the payment method type and last four digits, so that we can charge your recurring orders.

If you have a recurring order you can skip the next delivery, pause it, resume it or cancel it at any time from your My Subscriptions page. There is no self-service control for removing a stored payment method: to have one removed, email beef@shipleyfarmsbeef.com or call 828-484-1872 and we will remove it for you.
